Afromail Web Hosting – Personal Data and General Confidentiality Agreement
1. Parties
This Agreement is between Afromail Web Hosting (“Company”) and the client/user (“Client”) of hosting services provided by Afromail.
2. Purpose
The purpose of this Agreement is to ensure the protection of personal data and confidential information shared between the parties during the course of using Afromail’s web hosting services.
3. Definition of Confidential Information
Confidential information includes, but is not limited to:
- Personal data of clients, employees, or users (names, emails, phone numbers, addresses, payment information).
- Technical data, server configurations, and security measures.
- Business plans, strategies, and financial information.
- Any information marked as “confidential” or disclosed verbally with intent to remain private.
4. Obligations of the Company
- To protect personal data in accordance with applicable data protection laws of Zambia.
- To use personal data only for providing and improving hosting services.
- To implement reasonable security measures to prevent unauthorized access, disclosure, or loss of data.
- Not to share personal data with third parties without client consent, except as required by law.
5. Obligations of the Client
- To provide accurate and lawful personal data.
- To maintain the confidentiality of login credentials and account information.
- Not to misuse or share confidential information obtained from Afromail.
6. Data Processing and Storage
- Personal data may be stored on secure servers within or outside Zambia.
- Data will be retained only as long as necessary to fulfill service obligations or comply with legal requirements.
7. Breach of Confidentiality
In the event of a data breach or unauthorized disclosure:
- The Company will notify affected clients promptly.
- Reasonable steps will be taken to mitigate harm and prevent future breaches.
8. Termination
This Agreement remains effective for as long as the client uses Afromail’s services and for a reasonable period thereafter to protect confidential information.
9. Governing Law
This Agreement shall be governed by and interpreted under the laws of Zambia.
